Terms of service

1. Provision of Services
    1. The subscriber agrees to use services according to these terms of service starting from the installation date.
    2. The Subscriber is responsible for obtaining necessary approvals and authorizations for the supply, delivery, and installation of services.
    3. All risk in and to the Customer Premises Equipment (CPE) passes to the Subscriber upon delivery.
    4. If the CPE is lost, stolen, or damaged, the Subscriber must notify the company immediately and may be responsible for costs associated with replacement.
3. Use of Services and Equipment
    1. The Subscriber must not use the services in a way that causes harm, damage, or interruption of service to persons, property, or the services themselves.
    2. The Subscriber must only use the provided CPE.
    3. The Subscriber acknowledges that the CPE remains the property of the company and may not be modified or tampered with.
    4. Aggregation of the service, reselling of the services, or redistribution of the service through networking equipment is prohibited.
4. Duration and Cancellation
    2. After the initial contract term, the agreement continues on a month-to-month basis until cancellation or signing of a new agreement.
    3. Cancellation by the Subscriber is subject to notice and potential cancellation fees.
    4. The company may cancel the agreement under certain circumstances, with notice.
    5. Upon cancellation, the Subscriber may be liable for outstanding amounts and termination fees.
5. Payment
    1. Billing for services begins on the installation date.
    2. The Subscriber agrees to pay all amounts due in a timely manner.
    3. Payment is usually required upfront before the 7th of each month, with potential suspension and reactivation fees for late payments.
    4. Payment methods include direct debit, electronic funds transfer, or cash deposit.
    5. Failure to pay may result in further collection measures or termination of the agreement.
6. Support and Liability
    1. Faults should be reported through specified channels, and support is available during designated hours published on the website.
    2. The company is not liable for service disruptions caused by factors beyond its control.
    3. Customer equipment faults beyond the demarcation point may incur repair charges.
    4. The company's liability is limited, and it does not provide warranties regarding availability, accuracy, or security of services.
    5. The Subscriber indemnifies the company against losses or damages arising from misuse or failure to act as required.
7. Personal Information
    1. The company collects and uses personal data necessary for service provision and may use it for communication and marketing purposes.
    2. Appropriate security measures are implemented to protect personal information.
    3. The Subscriber acknowledges and consents to the collection and use of their data by the company.
8. General
    3. Notices from the company may be sent via email unless otherwise required by law.
    4. No indulgence or leniency granted by the company shall prejudice its rights.
    5. The subscriber must notify the company of any changes to their details.
    6. Disputes and jurisdiction are subject to the laws of the Republic of South Africa.
